PRIVACY POLICY

This website (the "Site") is operated by Smeg S.p.A., of Via Leonardo da Vinci, 4 - 42016 Guastalla (RE) Italy, VAT No. 01555030350, smeg@smeg.it ("SMEG", "we," "us," and "our") which is, as laid down in point 1, the data controller of personal data of users that visit and browse the Site, as well as of those users that register and use the services available at the Site.

Sales transacted through the online shop that is part of the Site (hereinafter “E-Shop”) and all the activities related to them (for example, handling of orders, sales, product delivery, payments handling, administering returns and warranties, after-sales activity) are carried out by PVS SERVICES ITALIA S.R.L. (hereinafter “Merchant”), a limited liability company with registered office in Italy, P.le Balestrieri 31/A, 43122 Parma, having share capital of Euro 100,000.00, tax code and VAT no. 02647480348 in its own name, in coordination with SMEG, to improve your buying experience.

This Privacy Policy tells you how SMEG and, where applicable, the Merchant, will use any personal data you provide or we collect through the Site.

Please note that we do not accept registrations or orders by minors (persons less than 18 years of age), nor do we knowingly gather or use their personal data. Minors are instructed not to register or not to make online purchases and to ask an adult to carry out the necessary procedures.

The definitions used in the General Conditions of Sale, which governing the sales of SMEG' s products carried out by the use of the web site www.sicilyismylove.com, are also applicable to the terms not defined hereinafter.

1. WHO IS THE DATA CONTROLLER


The controller of your personal data when you visit and browse the Site, and of your personal data if you register and use the account services available on the Site, with the exception of online purchases, is SMEG. In relation to the processing of the personal data connected with the purchases made through the E-Shop (including pre- and post-sales assistance), the data controller of the processing is the Merchant; you can contact the Merchant, or its Data Protection Officer, at its premises, at info@sicilyismylove.com, or at 800123753.


2. WHAT TYPE OF DATA WE COLLECT

Data provided when registering and when using the services

Registering at the Site and using its services are optional. Although registering at the Site makes your visits and purchasing simpler, you can also purchase online without registering.

If you register at the Site by creating your account or use any other services available at the Site, SMEG will collect and use your identification data (i.e. name and surname and gender) and will process your account data (i.e. username and password) to grant you access to your account and for managing the security of the Site. We will also store your purchase history in your account to allow you to review your purchases. If you consent to the marketing operations, SMEG may also collect your email to send you our offers and marketing communications about SMEG's products, services and surveys (including as part of customer satisfaction campaigns) from SMEG.

When you make a purchase, the Merchants will collect your identification data, your contact details and details of your payment information; should you ask for any aftersales service the Merchant will use that information in addition to the details of the products you have purchased to ensure you can benefit of the product warranty or any other service you are entitled to ask.

Updating of data

You are required to ensure that the personal data that you provide to SMEG is correct and updated. If any of the information you provide to SMEG when you register changes over the time, please update your account or by contacting us at the contact details indicated under point 7.


3. HOW WE USE PERSONAL DATA

Operating the Site, provision of the Site’s services and marketing activities

SMEG uses personal data you provide through the Site for the purposes and on the legal basis as follow:

a) to allow you to create an account on this Site through the registration form, process your registration and send you information about your account or change of our policies; the legal basis of this processing is that it is necessary to fulfill a contract;

b) to ensure the security of the E-shop, by trying to prevent unauthorized or malicious activities and frauds; the legal basis of this processing is that it is necessary to pursue our legitimate interest, which consists in the fraud prevention;

c) to comply with applicable laws e.g. in response to requests by government or law enforcement authorities conducting an investigation; the legal basis of this processing is that it is necessary to comply with legal obligations to which SMEG may be subject;

d) to e-mail you our newsletter if you subscribe to our newsletter; the legal basis of this processing is processing personal data to provide you the service;

e) if you consent, to receive marketing communications about SMEG's products, services and surveys (including as part of customer satisfaction campaigns) from SMEG by e-mail, ; the legal basis of this processing is your consent.

E-Shop, purchases and related activities

In relation to the processing of the personal data connected with the purchases made through the E-Shop (including pre- and post-sales assistance), the data controller of the processing is the Merchant which uses personal data you provide through the Site for the purposes and on the legal basis as follows:

f) to handle online orders and fulfill the sale contract or take steps linked to the sale contract , including invoicing, when you purchase our products on the Site as well as to provide you with pre and post-sales assistance and deliver the purchase products(s); in this case your personal data will be collected through the product order form on the Site and, for aftersales assistance will be processed by SMEG or its affiliates and local support centers in your country as data processors on behalf of the Merchant; the legal basis of this processing is that it is necessary to fulfill a contract and to comply with the legal obligations;

g) to comply with applicable laws e.g. in response to requests by government or law enforcement authorities conducting an investigation; the legal basis of this processing is that it is necessary to comply with legal obligations to which SMEG may be subject.

Whether providing your personal data is mandatory


Regarding the data processing purposes listed in points a), b), c), f) and g) the provision of data marked as mandatory during registration (or in other circumstances where users are requested to provide data) is necessary in order to use the services and any refusal makes it materially impossible to use the services.

The provision of data other than mandatory data is entirely optional and free, and any refusal does not in any way prevent users from using most of the services (except for those functionalities, such as newsletter, that require provision of additional data, in particular your e-mail address).

The provision of data for purposes in points d) and e) is not mandatory and any refusal does not in any way prevent you from using the services. However, where this happens SMEG may not be able, for example, to send you promotional material about products. In any case, it is understood that the processing of data for this purposes may only take place where there is the express consent of users and that consent can be refused.

Personal Data collected automatically through the Site

When you visit our Site SMEG may collect, in accordance with applicable laws and where required with your consent, information relating to the devices you use and the networks you are connected to when using our services. This may include the following information: your IP address, log-in information, browser type and version, browser plug-in types and versions, operating system and platform, advertising identifier, information about your visit including the URL clickstream to, through and from the Site, products you viewed or searched for, download errors, length of visits to certain pages, page interaction and any phone number used to call our customer service number. We collect this information using different tracking technologies including cookies (for further information please refer to our Cookie Policy ).


4. HOW LONG WE RETAIN YOUR PERSONAL DATA

Your personal data will be retained for the time needed to achieve the purposes described above.

In particular, the personal data shall be held by SMEG for the entire duration of the contractual relationship (for example, opening of the account), or, in the case of data relating to marketing purposes, until consent is withdrawn or there is an application for cancellation (for example, unsubscribing to the newsletters).

Also the Merchant will retain your personal data for the time necessary to achieve the purposes described above, including for fulfilling legal obligations (for example, keeping accounts for 10 years, holding data for invoicing purposes and for fulfilling tax obligations, where the data regards online purchases).

SMEG and the Merchant will keep your personal data in a form that allows you to be identified for the time strictly needed for the purposes for which the data was collected and subsequently processed, and, in any event, within the legal limits. In order to guarantee that your personal data is always precise and up-to-date, not to mention pertinent and complete, we ask that you please update it within the account section or by contacting us at the contact details indicated under point 7.


5. HOW AND WHERE WE RETAIN YOUR PERSONAL DATA

Your personal data is mainly processed electronically, and in some cases also in paper format.

If, in order to run the Site in a better and more efficient way, the data were to be transferred outside the EEA, we undertake to guarantee proper levels of protection and safeguard including of a contractual nature in accordance with the applicable rules, including making standard contract clauses and we will inform you by updating this Privacy Policy.


6. HOW WE SHARE YOUR PERSONAL DATA

So that the activities related to the Site function properly, your personal data indicated above may be accessed by employee staff, as well as by non-employee personnel appointed by SMEG and the Merchant – each for its part - that need to process the personal data to carry out their duties (for example, IT, administration, and customer service).

In addition, your personal data will be made available to third party companies that, on behalf of SMEG or of the Merchant (where applicable for the online sales), provide specific services in their capacity of data processors (for example, logistic services, provider which operates and host the Site on behalf of SMEG, including Iride Comunicazione S.r.l., with offices in Parma, Via Emilia Est 7, Italy), local aftersales providers. Your data will be disclosed to third parties that process your personal data independently and in accordance with the law in order to give effect to the purchase contract (for example, freight services, payment intermediaries or banks that perform remote electronic payment services by means of credit/debit cards).

SMEG or any of its assets, including the Site, may be sold, or other transactions may occur in which your personal data is one of the business assets of the transaction. In such case, your personal data may be transferred, either as part of the transaction or during any due diligence process.

Lastly, SMEG and the Merchant, each for its part - may share information with government and law enforcement authorities and with other parties involved in, or contemplating, legal proceedings to comply with a legal obligation, when we believe in good faith that the law requires it, or where this is necessary for us or for third parties to protect our or their rights, property, safety, or security.


7. YOUR RIGHTS AND HOW TO EXERCISE THEM

You have the right to access your personal data and, if necessary, have it amended or deleted or restricted. You may also ask us to provide some types of personal data to you, or another organisation nominated by you, in a structured and machine readable format.

You can opt out of receiving email newsletters by following the opt-out instructions provided to you in those emails or writing to the email address indicated below.

Please note that we will still send you certain communications relating to your account or use of the Site. These transactional account messages will be unaffected if you opt-out from marketing communications.

You can object to the processing of your personal data in some circumstances (in particular, where we don't have to process the information to meet a contractual or other legal requirement, e.g. in case of processing of data based on the legitimate interest or for our marketing communications) at any time either through the opt-out link at the bottom of our marketing e-mails, in case of marketing, or by contacting us at the contact details indicated below.

These rights can be limited – for example where we need your personal data (i) to comply with the law or (ii) to the interest of SMEG will prevail, or (iii) where providing your information would reveal personal data about another person.

You also have a right to complain to an EU data protection authority where you live, work or where you believe a breach may have occurred.

8. CHANGES TO THIS POLICY

We may change the terms of this Privacy Policy at any time, by prominently posting notice of the amendment on this Site. These changes will apply from the time they are posted. Previous versions of our Privacy Policy are available here.
